1. A Retainer of $300 is required and must be paid prior to commencement
of work, with the remaining balance to be paid prior to uploading
of your completed site.
2. Payments are to be made by cash, or check(s), allowing 7 days
to clear.
3. Delinquent Accounts: If a customer fails to pay for their service,
their web site will not be uploaded. If maintenance has not paid
then links will be broken and made inaccessible until all unpaid
balances and late fees have been paid. If a customer fails to pay
30 days after the initial completion date, web site will be removed
from the server; a construction page will be posted as the main
page. After 30 days a $10.00 per month late fee will be added.
4. New Sites: A website will only be publicly released by Draper
Web Design once the customer approves all site and web design as
complete and satisfactory and confirms this in writing via email.
5. Errors on the Site: Despite the best efforts of Draper Web
Design, errors in web page information will occur. At no time will
Draper Web Design take responsibility for accidentally including
erroneous information extend beyond correcting the error. If a
customer discovers an error on their site, Draper Web Design will
immediately correct the error as soon as we are notified. No charge
will be levied for error corrections.
6. Hosting Services: Draper Web Design cannot be held liable for
loss or damage caused as a result of third party action or failure.
7. Credits: Draper Web Design reserves the right to insert a link
button that returns to http://www.draperwebdesign.com at the bottom
of all web pages designed by Draper Web Design. We guarantee that
this link will not affect performance of the hosted site.
8. Page Content: Users are solely responsible for everything in
their website and Draper Web Design does not verify, endorse, or
take responsibility for the contents of your web page. Therefore,
we are not responsible for any claims and expenses that may arise
from illegal activity that we are unaware of, nor do we claim liability
for the contents of your site.
9. Refunds: No refunds are provided whatsoever; however, our company
will do everything within our means to create a site that is acceptable
to the client.
10. Appearance: Web sites do not look the same on all computers.
Colors, text size, etc. can look very different with different
browsers and different platforms. Although we do our best to provide
cross browser and cross platform compatibility, we cannot guarantee
that your site will look well on all browsers or on your computer.
11. Begin working on site: Draper Web Design will not begin working
on your site until your Retainer has been received and cleared.
12. Completion: The time estimated for your site to be completed
is never guaranteed. Quality is our primary importance when creating
your site.
13. Site Approval: You will be shown your site at least twice
before the site is published on the web. Once upon creation of
your home page, and when pages have been completed, prior to the
site being published. It is at this point that you, the customer,
must bring up problems and concerns. If during the first viewing
you feel the site is not to your approval, we will revise the site
to your specifications. After this time, it is not our responsibility
to revise your site unless you pay the normal fees.
14. Insufficient Funds: If a check received from you for payment
has insufficient funds, the construction of your web pages will
stop until the payment, as well as a $35.00 NSF charge, has been
sent to us in the form of cash, money order, or cashiers check.
We will then resume construction provided that the new check issued
to us does clear with sufficient funds.
15. Update Terms: Draper Web Design reserves the right to change,
update and append this agreement as necessary without notice.
16. Ownership:
Draper Web Design disclaims ownership of all photos, logos, pages,
documents, text, and other media provided by the
customer to Draper Web Design for use in a customer’s web
document(s).
17. Liabilities: In the event customer web documents are held
legally liable for any cause customer agrees to, in no way shape
or form whatsoever hold Draper Web Design liable for any damages
or other liabilities. This is to say that Draper Web Design will
not be held liable under any circumstances for any type loss including,
profit loss, damages, fees, or acts of God that may result in any
type of loss to a draperwebdesign.com customer or customers associated
business, organization, or entity.
18. Printing Site: We do not design our pages for hard copy printing
due to the many different brands and types of printers on the market.
We are not responsible for how your web pages print out using any
printer.
